Welcome to Delivo! These Terms and Conditions ("Terms") govern your use of the Delivo mobile application and website (collectively, the "Platform") operated by Delivo. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree, you may not access or use the Platform.

By using the Delivo Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. Delivo reserves the right to update or modify these Terms at any time. Your continued use of the Platform after any changes signifies your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use the Platform. By using Delivo, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement.

3. Account Registration

To access some features of Delivo, you may be required to create an account. You agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of your login credentials.
  • Accept responsibility for all activities under your account.

You may not transfer or share your account with any third party without our permission. Delivo reserves the right to suspend or terminate accounts that are found in violation of these Terms.

4. Service and Ordering

Delivo allows users to order food from partnered restaurants and food vendors. By placing an order:

  • You agree that the information provided (e.g., delivery address, payment information) is accurate and complete.
  • You understand that the delivery time may vary based on factors such as restaurant preparation time, weather, or traffic.
  • You agree that the delivery charge, order amount, and any applicable taxes are your responsibility.

Order Modifications and Cancellations: Once an order is confirmed, it may not be possible to modify or cancel it. Please contact our support team for assistance in special circumstances.

5. Payments

Delivo accepts multiple payment methods, including credit/debit cards, digital wallets, and other forms of electronic payment. You agree to:

  • Provide accurate and complete payment information.
  • Authorize Delivo to charge the total amount of your order, including applicable taxes and delivery fees, to your chosen payment method.

Payments are processed securely, and Delivo does not store your financial information.

6. Pricing and Promotions

Delivo strives to ensure that all pricing information is accurate. However, we reserve the right to correct any errors or inaccuracies, including order cancellations if necessary. Prices are subject to change without notice.

Promotional Offers: Delivo may offer discounts, promotions, or coupons from time to time. These offers are subject to specific terms and cannot be transferred, combined with other offers, or redeemed for cash unless explicitly stated.

7. Delivery

Delivo aims to deliver food promptly; however, we do not guarantee delivery times. Delivery times may be impacted by restaurant preparation delays, traffic, weather conditions, or other unforeseen factors. Delivo is not responsible for any delays or delivery failures due to circumstances beyond our control.

You must be available to receive your order at the specified address. If delivery is unsuccessful due to incorrect information or your unavailability, additional charges may apply for redelivery or cancellation.

8. Refunds and Returns

Due to the perishable nature of food, all sales are final. However, if you receive an incorrect or damaged order, or if there are any issues with the quality of the food, please contact Delivo within 24 hours of receiving your order, and we will work with the restaurant to resolve the issue.

Refunds, if applicable, are at the sole discretion of Delivo and may take up to 7 business days to process.

9. User Conduct

You agree to use the Delivo Platform in compliance with all applicable laws and regulations. You must not:

  • Use the Platform for any illegal or unauthorized purpose.
  • Interfere with or disrupt the operation of the Platform or its services.
  • Post or transmit any abusive, defamatory, fraudulent, or unlawful content.

Delivo reserves the right to terminate or restrict access to your account if we find that you are violating these Terms.

10. Intellectual Property

All content, including but not limited to text, images, graphics, and logos, provided on the Delivo Platform is the intellectual property of Delivo and its licensors. You may not copy, reproduce, or distribute any part of the Platform without prior written consent from Delivo.

11. Limitation of Liability

To the fullest extent permitted by law, Delivo, its affiliates, and partners shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, data, or goodwill.

Delivo’s liability for any claims arising under these Terms is limited to the amount paid by you for the relevant order.

12. Indemnification

You agree to indemnify and hold harmless Delivo, its affiliates, and partners from any claims, damages, liabilities, or expenses arising from your use of the Platform or violation of these Terms.

13. Third-Party Links

The Delivo Platform may contain links to third-party websites or services that are not owned or controlled by Delivo. We are not responsible for the content or practices of any third-party sites and encourage you to review their terms and policies.
